COURTESY NTICE Agricultural season always brings forth a rise in citizen complaints regarding irrigation equipment watering the county roadways. Under Idaho Code 18-3908 & Bingham County Ordinance 2009 05 it is illegal for any person to irrigate highway, road or street. or run water on any public Irrigation water on the county roadway shortens the life span of the road and increases the cost of maintenance and repair. With public funds being reduced and the continuous cost increase of road repair material it is imperative for the county and it's citizens to work together in the spirit of cooperation to prevent and reduce the amount of irrigation water on county roadways. llegal watering of the road creates dangerous and hazardous driving conditions to the motoring public, which could possibly hold the owner or caretaker of the irrigation system criminally accountable or civilly liable for a potential foreseeable tragic incident. Additionally, with the continuous concerns of drought and water shortages conservation of this vital resource should be respected as a priority Bingham County will be investigating and enforcing Water on the Road incidents and complaints. In order to decrease the likelihood of being found in violation it is recommended that you take the time to check your irrigation equipment and educate your employees on the legal requirements to ensure compliance and prevent the watering and/or irrigating of any public highway, road, or street.
